Terms of Use

These Terms of Use ("Terms") govern your use of the SendThis mobile application and related services (the "Service"). By using the Service, you agree to these Terms.

1. The Service

SendThis provides AI-assisted message rewrite suggestions based on text you submit, along with tone and context selections. Suggestions are generated automatically and may not always be accurate, appropriate, or suitable for your situation.

2. Eligibility

You must be legally permitted to use the Service under the laws that apply to you. If you are using the Service on behalf of another person or organization, you represent that you have authority to do so.

3. Acceptable Use

You agree not to use the Service to:

• break the law or encourage illegal conduct;
• harass, threaten, defraud, exploit, or impersonate others;
• submit content you do not have the right to use;
• attempt to reverse engineer, disrupt, or interfere with the Service; or
• use the Service in a way that could harm us, our providers, or other users.

4. AI-Generated Output

The Service uses automated systems to generate suggested wording. You are solely responsible for reviewing, editing, and deciding whether to use any output. We do not guarantee that generated suggestions will be correct, safe, non-infringing, or fit for a particular purpose.

SendThis relies on OpenAI models to generate certain outputs. As part of that process, prompts submitted through the Service may be processed by OpenAI through our backend infrastructure. For background on OpenAI’s terms and privacy practices, see OpenAI’s Terms of Use and OpenAI’s Privacy Policy.

5. User Content

You retain ownership of the text you submit to the Service. You grant us a limited right to process that content as necessary to operate, maintain, and improve the Service and to provide outputs to you.

You are responsible for ensuring that you have the rights and permissions needed for the content you submit.

6. Subscriptions and Billing

Certain features may require a paid subscription. Billing is handled by Apple through your App Store account. Subscription pricing, renewal terms, and cancellation options are shown to you at the time of purchase and in your Apple subscription settings.

Unless otherwise stated by Apple, subscriptions renew automatically until canceled. Refund requests are handled by Apple under Apple’s applicable policies.

7. Free Tier and Limits

We may offer a limited free tier and may set or change usage limits, feature restrictions, or eligibility criteria at any time.

8. Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable if the Service is unavailable, interrupted, or changed.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by law, SendThis and its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of the Service.

11. Termination

We may suspend or terminate your access to the Service if we believe you have violated these Terms or if continuing to provide the Service would create risk or legal exposure.

12. Governing Terms for Apple Users

If you access the Service through Apple’s App Store, you acknowledge that these Terms are between you and SendThis, not Apple, and that Apple is not responsible for the Service or its content except as required under applicable law.

13. Changes to These Terms

We may update these Terms from time to time. If we do, we will update the effective date above. Your continued use of the Service after updated Terms become effective means you accept the revised Terms.

14. Third-Party Services

The Service depends on third-party providers, including Apple, RevenueCat, Cloudflare, and OpenAI. We are not responsible for third-party services, websites, policies, or outages. Your interactions with those providers may also be governed by their own terms, privacy policies, and platform rules.
